Two Bolton landlords have been handed fines and a community service order for failing to have gas appliances in their rental property safety checked. The Heath and Safety Executive prosecuted the landlords after a couple and their four-month-old baby were rushed to hospital with carbon monoxide poisoning.

A Lucky Escape for a Young Family
The young couple moved into the property in Bolton shortly before their baby was born. Within a month of moving in the expectant mother began to feel ill and was taken to hospital. Her husband was also suffering from severe headaches, but unfortunately doctors failed to link the couple’s symptoms with carbon monoxide poisoning. In August of the same year, the couple were at home with their baby when all of them were taken ill and rushed to hospital.
The HSE Investigates
The Health and Safety Executive checked the property and discovered that two of the gas appliances in the home were dangerous and a further two were ‘at risk’ of causing CO poisoning. The landlords were asked to produce gas safety certificates for the appliances, but failed to do so because they hadn’t had the appliances checked.
As a result of their failure to have the gas appliances properly checked and serviced, the couple have been sentenced to 80 hours of community service and fined £720 plus costs.
Landlords are under a legal obligation to provide a Gas Safety Certificate to prove a registered gas fitter has checked gas appliances in a rental property. Checks must be made every year.
